These Terms of Service apply to your use of the Bloom by Sophia Rose online store and purchases made through it. In these Terms, “we,” “us,” and “our” mean Bloom by Sophia Rose, based in Indiana, United States.

Please read these Terms before placing an order. By placing an order, you agree to the Terms and policies presented to you at the time of purchase. Nothing in these Terms limits consumer rights that cannot be waived under applicable law.

1. Using our store

You must have the legal capacity to enter into a purchase contract. If you are a minor, a parent or legal guardian must place the order for you.

Please provide accurate, current contact, billing, and shipping information. If you create an account, keep your login details secure and contact us if you believe someone has used your account without permission.

You may not use our store for fraud, unlawful activity, harassment, unauthorized access, or activity that damages or disrupts the website or its services.

2. Our products

We sell stickers, magnets, notebooks, notepads, and related stationery. Some items are made to order. Product descriptions identify the design, size, quantity, and other available options; please check your selections before purchasing.

We aim to display products and describe them accurately. Screen settings, lighting, and the production process may cause small differences in color or appearance. These variations do not excuse a product that is defective or materially different from its description.

Unless a listing expressly states otherwise, purchasing a physical product does not include a digital artwork file, a reproduction license, or ownership of intellectual property rights.

3. Prices, payment, and orders

Prices are in U.S. dollars unless another currency is expressly displayed. Applicable shipping charges and taxes are shown at checkout before you submit your order. Payment is due when you place the order.

Prices, promotions, and product availability may change for future orders. We will not increase the price of an existing order without your agreement.

An order confirmation acknowledges receipt of your order. If we cannot fulfill an order, identify a material listing or pricing error, or reasonably suspect fraud, we may decline or cancel the affected order. We will notify you and promptly refund any payment for items we will not supply, together with any applicable shipping charges and taxes. We will not charge a corrected price without your agreement.

4. Made-to-order and personalized items

Production time is separate from carrier transit time. Please review the production and shipping information provided before checkout.

For personalized products, you are responsible for checking the spelling and custom details you submit. If you provide artwork or other material, you must have permission to use it for the requested product. You authorize us to use that material to produce and fulfill your order. We may decline requests that are unlawful or infringe another person's rights.

Making a standard product after an order is placed does not, by itself, make it a personalized product. Return and cancellation eligibility is explained in our Refund Policy.

5. Shipping and delivery

We currently ship within the United States only. Available shipping options and charges are displayed at checkout.

Please check your delivery address carefully and contact us immediately if it needs to be corrected. We will try to update an address before shipment, but cannot guarantee a change after an order has shipped. Any additional charge for reshipping a parcel because of an incorrect address you provided will be discussed with you before it is charged.

Delivery estimates are estimates unless a particular service is expressly guaranteed. If we cannot ship by the promised shipment date, we will notify you and offer the delay-consent and cancellation/refund options required by law. If we cannot fulfill the order, we will cancel it and provide the required refund.

Contact us if a parcel is missing or arrives damaged. We will investigate and provide an appropriate resolution in accordance with our Refund Policy and applicable law.

6. Returns, refunds, and cancellations

Our Refund Policy forms part of these Terms. It provides a 14-day return-request window for eligible unused, non-personalized items, with customer-paid postage for change-of-mind returns. Different provisions apply to personalized items and to damaged, defective, incorrect, or missing orders.

The version of the policy presented when you placed your order applies to that order, subject to any mandatory legal rights.

7. Website content and intellectual property

The designs, text, photographs, branding, and other content on this website are owned by us or used with permission from their respective owners, except where otherwise identified.

You may view and use the website to browse and purchase products. You may not copy, reproduce, distribute, or commercially exploit website content or product artwork without the rights holder's permission, except as allowed by law. Purchasing a physical item does not transfer the copyright in its design.

8. Privacy and third-party services

Our Privacy Policy explains how personal information is collected, used, and shared. It controls if there is a conflict with these Terms about handling personal information.

Our store is hosted on Shopify. Payment processing and other services may be provided by third parties and may be subject to their own terms and privacy notices. We remain responsible for our obligations as the seller of your order.

9. Website availability and responsibility

We make reasonable efforts to keep our website accurate and available, but cannot promise uninterrupted access or that every website error will be prevented. If you notice an error affecting your order, please contact us.

Nothing in these Terms excludes or limits liability, warranties, or remedies where doing so would be unlawful. In particular, these Terms do not remove our responsibilities for defective, incorrect, or undelivered goods.

We may restrict access to the website when reasonably necessary to address fraud, security threats, or a material violation of these Terms. Doing so does not remove our obligations for orders already placed or refunds legally owed.

10. Governing law

These Terms are governed by the laws of Indiana and applicable United States federal law, except to the extent that mandatory law requires otherwise. This choice of law does not deprive you of consumer protections that apply and cannot be waived.

Please contact us about a concern so we can try to resolve it. You retain any complaint procedures and legal remedies available under applicable law.

11. Changes and interpretation

We may update these Terms for future use of the store and future orders by posting a revised version with an updated date. Changes do not retroactively change the terms of an existing order without your agreement, unless required by law.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision does not, by itself, waive our right to enforce it later.
